99Moments provides a social service that allows registered users (members) to publish moments of personal interest online in order to share their experience with other people using the service. The services offered by 99Moments ("99Moments" or "we") include the 99Moments website (the "99Moments Website"), the 99Moments RSS-Feeds, and any other features, content, or applications offered from time to time by 99Moments in connection with the 99Moments Website. The 99Moments Services are hosted in Austria.

By using 99Moments (User) you agree to these Terms of Use, whether you are a Visitor (non-registered) or a Member (registered). You are only authorized to use the 99Moments Services (regardless of whether your access or use is intended) if you agree to abide by all applicable laws and to this Agreement. Please read this Agreement carefully and save it. If you do not agree with it, you should leave the 99Moments Website and discontinue use of the 99Moments Services immediately. If you wish to become a Member, create and share moments and make use of the 99Moments Services, you must read this Agreement.

You must not publish any offensive or insulting content, especially including any, pornography, racist, obscene, lewd, excessively violent, harassing, sexually explicit or otherwise objectionable subject matter.

Advertising of any kind (contests, pyramid schemes) is forbidden.

You must not promote any criminal activity or enterprise via 99moments.

Junk Mailing, Chain Letters and spamming of any kind are prohibited.

Any automated use of our system is forbidden.

Content provided by 99Moments Members may contain inaccurate, inappropriate, offensive or sexually explicit material and 99Moments assumes no responsibility or liability for this material.

If you become aware of misuse of 99Moments by any person, please contact us. The Members are solely responsible for the content that they share via 99Moments, and any material or information that they transmit to other Members and for their interactions with other Users.

99Moments does not endorse and has no control over the content.

99moments takes no responsibility of any content of any website linked in a content provided by members. 99Moments expressly reserves the right to remove your content and/or restrict, suspend, or terminate your access to any of 99Moments' Services if 99Moments determines, in ist sole discretion, that you pose a threat to 99Moments and/or ist Users.

99Moments may delete any content that in the sole judgment of 99Moments violates this Agreement or which may be offensive, illegal or violate the rights, harm, or threaten the safety of any person. 99Moments does not claim any ownership rights in the content (text, imagery, video) you publish at 99moments.

By displaying or publishing any content on or through 99Moments Services, you grant to 99Moments a limited license to use, modify, publicly perform, publicly display, reproduce, and distribute such content solely on and through 99Moments.

The presentation of your content on or through the 99Moments Services does not violate the privacy rights, publicity rights, copyrights, contract rights or any other rights of any person.

You agree to pay for all royalties, fees, and any other monies owing any person by reason of any content posted by you to or through 99Moments.

You may not post, modify, distribute, or reproduce in any way any copyrighted material, trademarks, or other proprietary information belonging to others without obtaining the prior written consent of the owner of such proprietary rights. 99Moments is not responsible for any incorrect or inaccurate content posted on the 99Moments Website or in connection with the 99Moments Services, whether caused by Users of the 99Moments Services or by any of the equipment or programming associated with or utilized in the 99Moments Services. In no event shall 99Moments be liable to you or any third party for and indirect, consequential, exemplary, incidental, special or punitive damages, including lost profit damages arising for your use of 99Moments even if 99Moments has been advised of the possibility of such damages. Notwithstanding anything to the contrary contained herein. 99Moments' liability to you for any cause whatsoever and regardless of the form or the action, will at all times be limited to the amount paid, if any, by you to 99Moments for the 99Moments services during the term of membership. This Agreement is accepted upon your use of the 99Moments Website or any of the 99Moments Services and is further affirmed by you becoming a Member. This Agreement constitutes the entire agreement between you and 99Moments regarding the use of the 99Moments Services. The failure of 99Moments to exercise or enforce any right or provision of this Agreement shall not operate as a waiver of such right or provision.

The section titles in this Agreement are for convenience only and have no legal or contractual effect. This Agreement operates to the fullest extent permissible by law.

If any provision of this Agreement is unlawful, void or unenforceable, that provision is deemed severable from this Agreement and does not affect the validity and enforceability of any remaining provisions.
